White House Crypto Adviser Discusses the CLARITY Act's Progress in the Senate

The executive director of the President’s Council of Advisors for Digital Assets provided an update on the progress of the CLARITY Act, a major piece of legislation aimed at establishing a regulatory framework for cryptocurrency.

The legislation has already passed in the House of Representatives. The Senate has taken up the bill and is crafting its own version. One portion of the bill, dealing with the Commodity Futures Trading Commission (CFTC), has successfully passed out of the Senate Agriculture Committee. However, the other portion, which covers securities regulations under the Securities and Exchange Commission (SEC), is currently stalled in the Senate Banking Committee.

A key committee session scheduled for January 18th was postponed. Officials are now working to address the concerns that led to the delay, with the hope of rescheduling it soon. Once the Banking Committee approves its portion, the two parts of the legislation will need to be reconciled before a final vote on the Senate floor.

According to the adviser, compromise is needed from all sides to move the bill forward. Both the crypto community and the banking sector have concerns that must be addressed. A significant sticking point involves the payment of rewards or “yield” on stablecoins. Some senators worry this could lead to deposits leaving traditional banks. The White House is encouraging both parties to find a middle ground on this specific issue without derailing the entire bill.

Beyond stablecoins, other areas still require negotiation, including the definitions and regulatory boundaries for tokenization and decentralized finance (DeFi). Despite these challenges, the adviser emphasized the bill’s importance, stating it provides critical regulatory clarity that would allow major financial institutions to participate in the crypto space while establishing clear jurisdictional lines between regulators like the SEC and CFTC.
